It's a tribal court. First People clamored for their own "justice" system throughout the years.  Most vocally when they perceive not getting a fair shake in the "white man" court system.  I'm ambivalent however, it's their problem.

FYI:  The gentleman in your post is of Sicilian ancestry...he's not Native American.

There are no Native Americans.  There are "we got here before you did Americans" but everybody either walked over the frozen ice surrounding the Aleutian Islands, during the last ice age, or they came over on a vessel.

You're most likely correct about the land bridge.  A few years back, spent a couple weeks wandering around Mongolia.  You'd swear they were speaking Yup'ik instead of Khalkha.  It was striking, though admittedly anecdotal, evidence. Anyone familiar with either language, could look at a globe and see a connection.

I suppose arriving "first" depends more upon the ability to stay, flourish, and meet existential threats rather than "ownership".

Most of the Indians didn't understand the concept of owning land, such as the Lenape Indians from the infamous Manhattan Purchase.  They thought they were just being paid not to hunt there anymore.  The British call them our Aborigines, which is also a more accurate title.
