I have to agree with this one. Keep him employed so he can pay off the civil suit that will follow. If he is jailed the victim will get a hefty verdict but may not be able to collect.

Did he break the law in an unusually callous and reprehensible manner? Yes.
Does the law say he should go to jail? Yes.
