I’ve met many outraged people who think that the law tells cops to pull you over if you are Mexican.

The law as originally written would allow them to do just that.  After the initial wave of outrage they revised it, but the problem is still that if you get pulled over or stopped on the street they can then insist that you prove your citizenship, and if you can't prove it on the spot they can detain you until you do, and if you are a legal non-citizen and don't have your papers on you, then you can be arrested and fined.

It's a retarded law that stirs up racial animosity  and won't do a thing about illegal immigration.  All it does is make some people feel good that think it's not fair and want more people to be punished because they're still mentally six years old and think life is supposed to be fair.

That's called a "Drivers License", if you don't have one then you should be arrested anyway - that is the law.

It's the Federal Law, it's California Law, it will soon be Arizona Law and it is the will of the people.

A driver's license does not prove that the detainee is here legally, so I don't think that will suffice for purposes of verifying status.  Morover, the law is not limited to traffic stops.  Indeed, all that it requires is that the police have a "reasonable suspicion" and not probable cause to believe that any crime has been committed.

The proof will be in the pudding, as they say, but I think it is extremely naive to think that race and ethnicity are not going to be major factors.  We are talking about Arizona after all.  Does this make it unconstitutional?  I am not sure.  I think it should be subject to "strict scrutiny" under the equal protection clause, but I am not sure how it will be decided.  The state will argue that even under strict scrutiny, there is adequate basis for the state's action.  On the other hand, once the Court determines that "strict scrutiny" is the appropriate standard for determining whether equal protection is being violated, typically the outcome is to find that the statute is unconstitutional.  The Roberts Court, however, has taken a fairly sharp right turn on some issues, and this may well be one of them.

We have lots of illegal aliens here in Florida and most of the ones around here are Europeans. They come over on a travel visa and spend their summers working in bars and pools and the like, taking out leases on apartments, trashing them and then going back home for "school" in the fall.

Since a US Drivers License requires valid identification to obtain it is generally accepted as proof of legal residence; doubley so by skittish cops.  Additionally Constitutional protections can not be validated by a state law and it will be interesting to see the first case as it hits the courts - which it will and it will be a setup - but the sooner the better.

In the end the courts will have their say in this and the first round appears to be going to AZ as the Justice Dept's approach is flimsy at best, especially considering that they encourage local repetition and enforcement of other federal laws (drugs for example).

My biased and uneducated opinion is that they will have to strike down the Federal law first before they can block the AZ law; and that just ain't gonna happen.  (Another point to note is that this very same law has stood in California for many years.)

In the end it is important to keep in mind that nationwide this statute enjoys a 60~70% support rating and what the people want the people will get.
