Not even remotely "Serves them right". While Apple and IBM are great examples of tech bullies, it is now becoming more lucrative to file lawsuits than actually innovate. Oracle - once an innovator - now is quickly moving over to troll territory due to some of their recent license audit practices and resulting lawsuits.
Personally I'd like to see a viable product timeline requirement for all patents. Otherwise we end up with a bunch of weasels preventing actual innovators from producing anything, and we - the end consumer - end up with jack shit.

Yeah but it would be anti free markets and downright unAmerican to interfere with the Tech Billionaires in their quest to become Oligarchs. Besides, What about trickle down effects. They will still inovate with designs of their Yachts, planes and spaceships. Right now I am standing at the back of Steve Jobs yacht. Very innovative slab design he did himself. Looks like a 200 foot long Iphone box. Only one SAR transponder sticks up above the sides.
