He claims he has the first Copyright to the Email. That may be true, but that is very, very different than a patent, or even a Trademark. Copyright only protects him from people that want to copy his shitty source code. Trademark to the term is what gives you rights and would only protect usage of the term Email, not any of the underlying technology. And no copyright/trademark court is give him damages, there is a long history of his failing to protect or defend his trademark, so he's resorted to an 11th hour attempt to defend it, but that rarely works. It appears he knows that so is pushing the PR end instead of the legal end because he knows he has no standing.

Still, he got awarded $750k from Gawker, likely because they didn't have enough cash at the time to hire a lawyer to defend against it and knew they were too broke to pay anything anyway. I would be surprised if he got back his court costs on that case after the bankruptcy.

But hey, at least his mom thought he was smart...
