That seems weird to be building in qualifications like that. What's next? You've been charged with "having sex with a dog, and it wasn't even your dog"? "killing someone, and they didn't totally have it coming or anything"? "stealing something that would be missed"?

Well, punishing someone for stealing something that wouldn't be missed would be silly, especially as they probably wouldn't even realize it was gone.
