Maybe the guy's lawyer should use the same lame argument the anti-second amendment proponents are throwing out. The event didn't happen in D.C., therefore it's not a federal issue and the first amendment is not applicable.

They may have Freedom of Speech, but perhaps local police departments can decide they have better things to do than protect them from angry crowds when they exercise that right at funerals.
