The entire saga has been fascinating in a train-wreck fashion. It could have worked; the idea was sound, though totally morally bankrupt. They just botched the execution in a colossal way. They tried to litigate everything themselves, having the chutzpah but not the brains to convincingly lie to multiple courts and properly set up corporate shells to obfuscate the scam. Had they brought in some heavy hitter like Boies, Schiller, and Flexner with extra credibility to burn they could have sustained things, but they were too greedy and arrogant to cut anyone else in. Even housekeeper Alan Cooper wasn't paid extra for having his name slapped on paperwork as a "corporate officer."
Their other main goof was not putting in the spade work to properly rig the courts, instead relying on the inherent bias there against copyright defendants. Once the fraud and deception became apparent, enough courts turned against them and started asking difficult questions to make the enterprise collapse, though it should be noted that many courts still tolerated or supported them. Had they worked to establish rules and relationships with the right courts and got cases steered to those venues, it would not have been so easy to collapse the house of cards once defendants started lawyering up.
In short, any lawyer - including the prosecution - who claims that this conduct falls outside the norms of their profession is lying to his audience and possibly himself. Had the scheme been executed by brighter people more willing to spread the money around, it would be continuing to this day with a full-throated defense by members of the bar.
