I don't care who has a damn trademark - it's been taco tuesday in my house for my entire life so they Taco John can suck the pickled peppers right off of my fucking taco filler.

I am far from being an intellectual property lawyer, but I do know that you can lose a trademark if the mark becomes "generic.". Marks like "Kleenex," "Xerox" and "lTaser" have risked becoming generic.
